SA2L PHARMACIE, S.L. - NOIRFONCE through the present General Terms and Conditions of Purchase offers its users and visitors the possibility of making the on-line purchase of the products offered, in addition to establishing communication with the user. 

SA2L PHARMACIE, S.L. - NOIRFONCE will develop its e-commerce activity as a virtual store through the website https://noirfonce.es/

SA2L PHARMACIE, S.L. - NOIRFONCE may alter at any time and without notice, the design, presentation and / or configuration of the Website, as well as some or all services.

1.3 Acceptance of the General Terms and Conditions

Access and use of the NOIRFONCE website service implies full and unreserved acceptance by the User of all the conditions contained in these General Terms and Conditions of Purchase. Likewise, SA2L PHARMACIE, S.L. - NOIRFONCE reserves in any case the unilateral right to modify these General Terms and Conditions. 

Any order placed with SA2L PHARMACIE, S.L. - NOIRFONCE necessarily implies as an essential, determining and indispensable condition, the acceptance without reservation by the customer of the General Terms and Conditions of Purchase of its products, in force on the day on which the corresponding order is placed. Furthermore, the customer acknowledges that the acceptance of these General Terms and Conditions of Purchase shall imply their application to the order to which they refer, as well as to any subsequent order, with the exception of those cases in which new conditions are brought to its attention by SA2L PHARMACIE, S.L. - NOIRFONCE.

The fact that SA2L PHARMACIE, S.L. - NOIRFONCE do not refer at any given time to any of these conditions shall not be construed as renouncing to refer to them in the past or in the future.

2. ON-LINE SHOPING PROCESS 

2.1 Our products, how to find them?

SA2L PHARMACIE, S.L. - NOIRFONCE, in addition to having physical stores, offers you a virtual store to make it easier for you to buy our products. 

From the home page you can access all levels of product families. You can also find products in SA2L PHARMACIE, S.L. - NOIRFONCE through the search engine, where you just have to enter a keyword (which can be the name of the product, characteristics and even incomplete words) and hit the search button.

2.2 Products categories 

All products have a detailed card, which includes a photograph, name, description and price including taxes. The prices that appear in the product cards are an invitation to the customer to make an order proposal; therefore, if there is an error in the same, SA2L PHARMACIE, S.L. - NOIRFONCE will inform the customer of this circumstance and will not process the order.

Once the products have been selected, they will be added to the Shopping Cart, where the user will be able to add or remove products at any time. Once the product selection process is completed, or directly through the "BUY" button, the visitor may complete the product selection process and proceed to payment.

2.3 Purchase procedure 

In order to purchase, the user can register on our e-commerce platform, registering through a user registration form, or without registering previously in the same, buying as a guest. 

To place an order through our e-commerce platform, regardless of registration, the User must complete our form, providing us with the following information:

- Complete postal address, 

- E-mail address and 

- Contact telephone number.

In addition, the registered user will be able to receive information about offers and promotions if he/she wishes, and to know the status of the processing of his/her orders. 2.4 Availability of products.

The selection of products offered through SA2L PHARMACIE, S.L. - NOIRFONCE is valid as long as the products are visible on the website. Being e-commerce, the stock is updated online so it could happen, eventually, that during the purchase process the stock runs out, not being able, therefore, to continue with the purchase initiated.

In the event of a stock shortage or temporary unavailability of an article, SA2L PHARMACIE, S.L. - NOIRFONCE will contact the customer to inform him immediately and give him a new delivery time or, if it is not possible to serve the product, proceed to its cancellation.

2.5 How are orders processed? 

The purchase of the products must be made through the activation of the button "add to cart" that appears in the purchase request, and expresses the total acceptance of each and every one of these Terms and Conditions of Purchase, as shown in https://noirfonce.es/

When we click on the button to process the order (after having selected the products and units), the registered user must enter their username and password, directly accessing a personalized purchase panel, where you can modify your shipping address data and select the different types of shipments and payment methods; in the case of purchase as a guest, you will be asked for personal data for the processing of the order and delivery of the same.

2.6 Prices 

The prices applicable to each product, including VAT, are those indicated in the product sheet. During the purchase process will appear detailed the amount corresponding to the tax charge according to the current rate in force and applicable to the products marketed, as well as the corresponding shipping costs broken down before the order confirmation.

The offers shall be duly marked and identified as such, conveniently indicating the previous price and the price of the offer.

SA2L PHARMACIE, S.L. - NOIRFONCE reserves the right to make, at any time and without prior notice, the changes it deems appropriate, and may update products and services on a daily basis depending on the market.

The corresponding shipping costs are always indicated in the order. 

In shipments made to countries outside the European Union, SA2L PHARMACIE, S.L. - NOIRFONCE will not assume the expenses corresponding to taxes and customs duties of each country.

In the event of a price variation, SA2L PHARMACIE, S.L. - NOIRFONCE will communicate by email to the customer the variation and the customer may choose to cancel the order without being charged any additional cost.

2.8 Methods of payment 

SA2L PHARMACIE, S.L. - NOIRFONCE offers various methods of payment so that the customer can choose the one that suits him best or best suits his needs:

- Payment by Credit Card Visa, MasterCard and American Express, which have developed a system to securely make payments on the Internet. The Secure E-Commerce system is based on the card issuer identifying the cardholder before authorizing payment over the Internet. SA2L PHARMACIE, S.L. - NOIRFONCE reserves the right to refuse any credit card transaction. In this case we will proceed to refund the cash on the original card. In these cases and if the customer is interested in progressing with the purchase of the items we will request a bank transfer.

Paypal, ShopPay, Apple Pay or Gpay account: Secure payment system in which the user opens an account in the system that subsequently allows you to make payments in many online stores around the world, using your credit or debit card. The payment system will be the only one that will have the customer's bank details being an intermediary between the customer and SA2L PHARMACIE, S.L.- NOIRFONCE. When the customer makes the payment, the payment is immediate. In this way, SA2L PHARMACIE, S.L.- NOIRFONCE receives it and starts to process the order (after verifying that the data are correct). 2.8.- Non-payment.

Once the agreed due date for shipment, in the event of total or partial non-payment by the customer, SA2L PHARMACIE, S.L. - NOIRFONCE may suspend or cancel any shipment, without incurring liability for any damages or losses, including lost profits, or damages for delay or loss of production caused to the customer. The foregoing power of SA2L PHARMACIE, S.L. - NOIRFONCE, in no case, will release the customer from its contractual obligations in relation to payments due and receipt of products. 

2.9.- Invoicing.

SA2L PHARMACIE, S.L. - NOIRFONCE shall be obliged to issue an invoice to those customers who require it. Said invoice shall include the concept and the detail of the amounts received for the shipment of the orders requested.

2.10.- Transport and shipping costs.

Shipping and/or handling costs are not included in the price and will be shown to the customer before finalizing the purchase, depending on the shipping address of each order. 

For orders with delivery in Spain peninsula, when they were superior to 80 euros, the shipping costs will be free for the buyer. For orders with delivery in France, when they are superior to 120 euros, the shipping costs will be free of charge for the buyer. For all other situations, shipping costs include several types of flat rates, specified at the time of purchase and to be paid by the purchaser. 

SA2L PHARMACIE, S.L. - NOIRFONCE cannot be held responsible for any delays in shipping due to:

a) Incorrect or incomplete address

b) Failure to provide a contact telephone number

c) Strikes of the carriers and situations of force majeure.

If the customer does not appreciate external breakages in the package at the time of receiving it, but when opening it observes damage due to transport, you must notify within 24 hours to the carrier to record and contact SA2L PHARMACIE, S.L. - NOIRFONCE. Otherwise, it will be understood that the product has been accepted in conformity. Once the above period has elapsed, the transport company considers that the goods sent are in perfect condition and is not responsible for any defects.

2.11.- Delivery of the products.

The products will be sent to the shipping address that the customer has indicated in the order. In the case of placing an order for several items with different availabilities, the delivery time will take into account the longest expected delivery. The courier does not deliver on Saturdays, Sundays or holidays. 

It is not possible to agree delivery times. The delivery time will be from 24 to 72 working hours after the order is placed for products available for immediate shipment. In case you request a product that we do not have in stock the delivery time may vary. 

In the event that the customer detects any problem at the time of delivery of your order (damaged packaging, defective products, missing or damaged) must indicate it in writing on the delivery note of the carrier, and notify SA2L PHARMACIE, S.L. - NOIRFONCE via email, within 24 hours of receipt of the order. 

No return of damaged or used items will be accepted, as well as claims for missing items, if it has not been communicated within the deadline. All this without prejudice to the right of guarantee for products not in conformity with the contract that every consumer is entitled to, in accordance with current regulations.

3. CHANGE, CANCELLATION AND RETURN OF ORDERDS 

3.1. Exchange. 

It is not allowed to make changes of the products ordered, in case the user wishes, you can make a return or withdraw the contract, in accordance with the provisions of these Terms of Purchase and then buy the product you want.

3.2.- Cancellation.

Orders may be canceled in whole or in part while the shipment has not entered the processing phase, either in picking or packing. For this purpose, NOIRFONCE will send an email to the buyer notifying him that his order has entered the processing phase.  For any cancellation of the order, you must notify it as soon as possible via email. 

In case of cancellation of an order once it has already been confirmed and shipped, the customer will be responsible for the transport and processing costs incurred.

The cancellation of orders placed by the customer is not allowed when the product is custom-made, personalized or following the customer's instructions. 

As a consequence of the cancellation with the right to reimbursement, the amount of the purchase will be refunded using the same means of payment used for the initial transaction. 

For credit cards, the amount will be refunded at the end of the monthly billing period. The exact date of the refund depends on the credit card agreement between the bank and the customer. 

Any difference in amount between the original order and the modified order will be processed following the procedure corresponding to the chosen payment method. The costs of return and reshipment will not be assumed by SA2L PHARMACIE, S.L. - NOIRFONCE.

On the other hand, SA2L PHARMACIE, S.L. - NOIRFONCE may not replace a product or product model without prior consultation with the customer. If it should happen that, for reasons beyond the control of SA2L PHARMACIE, S.L. - NOIRFONCE, the supply of the order is not possible, the customer will be offered the possibility of exchanging it for a substitute product of similar characteristics, granting the right to cancellation of the order by the customer.

3.3 .- Return of orders.

Orders may be returned within 14 days from the date of the delivery, and for this purpose the Customer must contact SA2L PHARMACIE, S.L. - NOIRFONCE by e-mail or process your return through our RETURNS CENTER.

Conditions for return.

The return of orders placed by the customer is not allowed when the product is custom-made, personalized or following your instructions. 

The product must not have been used and must be returned with the same original packaging that was received, as well as the original labels and stickers. Products that have been modified cannot be returned. 

The customer must have the purchase invoice. In case of not having it, it must be in SA2L PHARMACIE, S.L. database. - NOIRFONCE. 

The customer will be responsible for the shipping costs in case of return. 

The item to be returned must be properly packaged for return. The item and its packaging must be protected by a shipping box.

The shipping costs of the order will not be refunded.

There will be causes for return of products:

That the product does not comply with the characteristics of the card shown on our website. In this case, SA2L PHARMACIE, S.L. - NOIRFONCE will organize the collection of the article and the amount of the purchase will be refunded. This refund will be made to the payment method used by the client at the time of purchase. To manage the return of these products, the Customer should contact SA2L PHARMACIE, S.L. - NOIRFONCE by e-mail.

That the product comes from defective origin. In this case, the product will be exchanged for an identical one once we have received the product to be returned and we have confirmed its defect in origin. If the defect is confirmed in origin, SA2L PHARMACIE, S.L. - NOIRFONCE will be responsible for the return and reshipment costs. To manage the return of these products, the Customer must contact SA2L PHARMACIE, S.L. - NOIRFONCE by e-mail.

4. RIGHT OF WITHDRAWAL.

The customer has the right to cancel the purchase within 14 calendar days without justification, for all orders that have not been made to measure or following the customer's instructions. To do this, you must complete the withdrawal form.

The withdrawal period will expire after 14 calendar days, starting from the day on which the customer or a third party indicated by the customer, other than the carrier, received the order.

4.1 Products not subject to the right of withdrawal.

In cases of orders made to order or under the instructions of the customer shall apply paragraph c) of Article 103 of Real Decreto Legislativo 1/2007, de 16 de noviembre, por el que se aprueba el Texto Refundido de la Ley General para la Defensa de los Consumidores y Usuarios y otras leyes complementarias, which provides as follows: 

"The right of withdrawal shall not apply to contracts relating to:

(c) The supply of goods made to the specifications of the consumer and user or clearly personalized".  (translation made by NOIRFONCE) 

Consequently, in the case of custom-made products and/or products customized according to the customer's instructions, the customer may not exercise the right of withdrawal.

4.2 .- Form of exercise of the right of withdrawal.

To exercise the right of withdrawal, you must send the withdrawal form to SA2L PHARMACIE, S.L. - NOIRFONCE by e-mail to info@noirfonce.eu. Or, the Client may exercise the right of withdrawal directly through our RETURNS CENTER.

To meet the withdrawal period, it is sufficient that the communication regarding the exercise of the right on your part is sent before the expiration of the deadline.

In case of withdrawal, all payments received will be refunded. However, the customer shall bear the direct cost of returning the goods.

Payment will be made without undue delay and, in any case, no later than 14 calendar days from the date on which the customer reports the withdrawal. Such reimbursement shall be made using the same means of payment used for the initial transaction, unless expressly provided otherwise; in any case, the customer shall not incur any costs as a result of the reimbursement.

5. WARRANTIES.

All products have the warranty indicated by the manufacturer, in accordance with the provisions of the applicable regulations. All products have a two-year warranty from the date of delivery, although it does not include deficiencies caused by negligence, blows, misuse or improper handling. In addition, the warranty will lose its value if the purchase invoice is missing.Blows and/or improper transportation, 

Fault or negligence of the customer or third party, 

Incorrect use, 

Damage as a result of force majeure.

6. LIABILITY OF THE CUSTOMER.

The customer agrees to make lawful use of the website, without contravening current legislation, or harm the rights and interests of third parties or NOIRFONCE.

The customer guarantees the truthfulness and accuracy of the data provided when filling in the contracting forms, avoiding causing damage to SA2L PHARMACIE, S.L. - NOIRFONCE as a result of the incorrectness of the same. 

It also undertakes to enable the delivery of the requested order by providing a delivery address where the requested order can be received within the usual schedule of delivery of goods (Monday to Friday from 10:00 to 13:30 and 16:00 to 19:00).

Failure to comply with any of these General Conditions of Contract may result in the cancellation or cancellation of orders by SA2L PHARMACIE, S.L. - NOIRFONCE without prior notice to the customer and without any right to compensation.

In case of rejection of the shipment by the customer, SA2L PHARMACIE, S.L. NOIRFONCE will not reimburse the customer. - NOIRFONCE will not reimburse the amount of shipping costs, these being borne by the customer.

The intellectual and industrial property rights on the works, trademarks, logos, and any other susceptible of protection, contained in the Web page correspond exclusively to SA2L PHARMACIE, S.L. - NOIRFONCE, unless different ownership is indicated therein. 

The unauthorized reproduction, distribution, commercialization or transformation of such works, trademarks, logos, etc. constitutes an infringement of the intellectual and industrial property rights of SA2L PHARMACIE, S.L. NOIRFONCE or of the owner. - NOIRFONCE or the owner thereof, and may give rise to the exercise of any judicial or extrajudicial actions that may correspond to them in the exercise of their rights.

Likewise, the information to which the customer can access through the Web site may be protected by industrial, intellectual or other property rights. The Company shall not be liable in any case and under any circumstances for any infringement of such rights that you may commit as a user and / or customer.

9. NOTIFICATIONS.

All notices, requirements, requests and other communications to be made by the parties in connection with these General Terms and Conditions of Purchase must be in writing and shall be deemed to have been duly sent by regular mail to the address of the other party or its email.

10. NULLITY AND INEFFECTIVENESS OF THE CLAUSES.

If any clause included in these Particular Conditions of the Contract is declared, totally or partially, null or ineffective, such nullity or ineffectiveness will only affect that provision or the part of the same that is null or ineffective, with the rest of the General Conditions of Purchase remaining in force. Consequently, the clause declared totally or partially null or ineffective shall be deemed not to have been included.

11. MANAGEMENT OF COMPLAINTS AND CLAIMS

We inform you that in case of filing a complaint or claim, you will be assigned an identification code and a written receipt that will be sent to you through the means of contact determined by you, leaving a record of the complaint or claim filed by you.

SA2L PHARMACIE, S.L. - NOIRFONCE, will respond to your complaint or claim as soon as possible and in any case within a maximum period of one month from the submission of the same. In the event that your request is not satisfactorily resolved, you may go to the ordinary jurisdiction or process your claim through the website http://ec.europa.eu/odr, which will provide free of charge a single point of access for out-of-court resolution.

12. APPLICABLE LEGISLATION AND SUBMISSION TO JURISDICTIONS.

The purchases and sales made in The Company are subject to Spanish law.

In the event of any conflict or discrepancy arising in the interpretation or application of these contractual conditions, SA2L PHARMACIE, S.L. - NOIRFONCE submits to the consumer arbitration system / to the Courts and Tribunals which, where appropriate, will hear the matter, and which will be those provided for in the applicable legal regulations regarding competent jurisdiction: in the case of end consumers, to the place of performance of the obligation or to the domicile of the purchasing party.

In the event that the purchasing party acts on behalf of a legal entity, both parties submit, expressly waiving any other jurisdiction, to the Courts and Tribunals of the location of the purchasing party.
