SA2L PHARMACIE, S.L. - NOIRFONCE will carry out its electronic commerce activity as an online store via the website https://noirfonce.eu/. SA2L PHARMACIE, S.L. - NOIRFONCE reserves the right to modify at any time and without prior notice the design, presentation, and/or configuration of the Website, as well as some or all of the services.

1.3 Acceptance of the specific purchase conditions.

Access to and use of the service of the NOIRFONCE website imply the user's full and complete acceptance of all the conditions set forth in these General Purchase Conditions. Furthermore, SA2L PHARMACIE, S.L. - NOIRFONCE reserves the right in all cases to unilaterally modify these General Conditions.

Any order placed with SA2L PHARMACIE, S.L. - NOIRFONCE necessarily implies, as an essential, determining, and indispensable condition, the client's unreserved acceptance of the General Purchase Conditions of its products in effect on the day the corresponding order is placed. Furthermore, the client acknowledges that the acceptance of these General Purchase Conditions will imply their application to the order to which they refer, as well as to any subsequent order, except in cases where new conditions are brought to their knowledge by SA2L PHARMACIE, S.L. - NOIRFONCE. The fact that SA2L PHARMACIE, S.L. - NOIRFONCE does not make use of any of these conditions at a given time cannot be interpreted as or equal to a waiver of their use in the past or future.

2. ONLINE PURCHASE PROCESS.

Additionally, you can find products at SA2L PHARMACIE, S.L. - NOIRFONCE through the search engine, where you simply enter a keyword (which can be the product name, features, or even incomplete words) and click the search button.

2.2 Categories/Families of products:

All products have a detailed sheet, including a photo, name, description, and price inclusive of all taxes. The prices appearing on the product sheets constitute an invitation to formulate an order proposal; therefore, in case of error, SA2L PHARMACIE, S.L. - NOIRFONCE will inform the client of this circumstance and will not process the order. 2.5 How are orders processed?

The acquisition of products must be carried out by activating the "add to cart" button that appears on the purchase request and expresses total acceptance of each of these General Purchase Conditions as displayed on https://noirfonce.eu/ before the acquisition of the products. When clicking the "place order" button, registered users must enter their username and password to access a personalized order board; guest users will be asked for personal data for order processing and delivery.

2.6 Price.

The prices applicable to each product, including VAT, are indicated on the product sheet. During the purchase process, the amount corresponding to the tax burden based on the current rate, as well as the corresponding shipping costs, will be detailed before order confirmation. For shipments to countries outside the European Union, SA2L PHARMACIE, S.L. - NOIRFONCE will not cover customs costs and duties specific to each country. 2.7 Payment methods.

SA2L PHARMACIE, S.L. - NOIRFONCE offers various payment methods:

  • Paypal, ShopPay, or Gpay account: Secure payment systems where the user opens an account. The payment system is the only one to have the client's banking data.

2.8 Non-payment.

In case of total or partial non-payment by the client, SA2L PHARMACIE, S.L. - NOIRFONCE reserves the right to suspend or cancel any shipment without liability for damages or losses.

2.9 Invoicing.

SA2L PHARMACIE, S.L. - NOIRFONCE will be required to issue an invoice to all clients who request one.

2.10 Transport and shipping costs.

Shipping and/or management costs are not included in the price and will be presented before finalization.

  • Spain: Free for orders over 80 euros.
  • France: Free for orders over 120 euros. NOIRFONCE is not responsible for transport delays due to incorrect addresses, lack of contact numbers, strikes, or force majeure. If transport damage is discovered upon opening the package, it must be reported to the transport company and NOIRFONCE within 24 hours.

2.11 Delivery of products.

Products will be sent to the delivery address indicated by the client. The delivery time will be 3 to 8 business days for products available for immediate shipment. No deliveries are made on Saturdays, Sundays, or holidays. Any problem during delivery (damaged packaging, missing products) must be noted in writing on the carrier's delivery note and reported to NOIRFONCE by e-mail within 24 hours.

3. MODIFICATION, CANCELLATION, AND RETURN OF ORDERS.

3.1.- Exchange.

Exchanges for ordered products are not permitted. If the user wishes, they may process a return or terminate the contract in accordance with these Purchase Conditions, and subsequently purchase the desired product.

3.2.- Cancellation.

Orders may be cancelled in full or in part as long as the shipment has not yet reached the processing phase, whether in picking or packing. In this regard, NOIRFONCE will send an email to the buyer to inform them that their order has entered the processing phase. Any order cancellation must be notified as soon as possible by email.


In the event of cancellation of an order already confirmed and shipped, the customer must bear the transport and processing costs incurred.


Cancellation of orders made by the customer is not permitted when the product is made to measure, personalized, or according to their instructions.


In the event of cancellation with a right to a refund, the refund will be made using the same payment method used for the initial transaction, unless expressly indicated otherwise.


For credit cards, the amount will be refunded at the end of the monthly billing period. The exact date of the refund depends on the credit card agreement between the bank and the customer. Refunds by bank transfer will be made within the following seven working days, or in accordance with the provisions of the corresponding bank.


Any difference in amount between the original order and the modified order will be processed in accordance with the procedure corresponding to the chosen payment method. Return and re-shipping costs will not be borne by SA2L PHARMACIE, S.L. - NOIRFONCE.


For its part, SA2L PHARMACIE, S.L. - NOIRFONCE may not replace a product or a product model without prior consultation with the customer. If, for reasons beyond the control of SA2L PHARMACIE, S.L. - NOIRFONCE, the supply of the order is not possible, the customer will be offered the possibility of replacing it with a product of similar characteristics. The customer will be offered the possibility of exchanging it for a substitute product with similar characteristics, granting them the right to cancel the order.

3.3.- Returns of orders.


Orders may be returned within 14 days from the date of purchase, and to do so, the customer must contact SA2L PHARMACIE, S.L. - NOIRFONCE by email or process your return through our RETURN CENTER.

Return conditions.

Returns of orders made by the customer are not permitted when the product is made to measure, personalized, or according to their instructions.


The product must not have been used and must be returned in its original packaging, along with the original labels and stickers. Modified products cannot be returned.


The customer must have the purchase invoice. If it is not available, it must appear in the database of SA2L PHARMACIE, S.L. - NOIRFONCE.


The customer must bear the return costs in the event of a return, which must be paid directly to the transport company at the time of collection. No material received freight collect will be collected.
The item to be returned must be correctly packaged for its return.
The shipping costs of the order will not be refunded.

Once the goods are received in our warehouses and it is verified that the item meets the required return conditions, we will proceed to refund the purchase amount in the same payment method used for the initial transaction.


The reasons for returning products will be as follows:

If the product does not correspond to the characteristics of the file displayed on our website. In this case, the amount of the product will be refunded, with the exception of shipping costs. This refund will be made by the payment method used by the customer via refund.


If the product was originally defective. In this case, the product will be exchanged for an identical product after receipt of the product to be returned and confirmation of its original defect. If the defect is confirmed at the source, SA2L PHARMACIE, S.L. - NOIRFONCE will bear the costs of return and re-shipping. 4. RIGHT OF WITHDRAWAL.

The customer has the right to withdraw from the purchase within a period of 14 calendar days without the need to justify their decision, for all orders that have not been made to measure or according to the customer's instructions. To do so, they must complete the withdrawal form, which can be found HERE.
The withdrawal period expires 14 calendar days from the day on which the customer or a third party designated by them, other than the carrier, has taken possession of the order.

4.1.- Products not subject to the right of withdrawal.

In the case of orders made to measure or according to the customer's instructions, Article 103 c) of Royal Legislative Decree 1/2007 of November 16, approving the Revised Text of the General Law for the Defense of Consumers and Users and other complementary laws, applies as follows:


"The right of withdrawal shall not apply to contracts relating to:
c) the supply of goods made to the specifications of the consumer and user or clearly personalized."


Therefore, in the case of products made to measure and/or products personalized according to the customer's instructions, the latter may not exercise their right of withdrawal.

4.2.- Exercise of the right of withdrawal.


To exercise your right of withdrawal, you must send the withdrawal form to SA2L PHARMACIE, S.L. - NOIRFONCE by e-mail to info@noirfonce.eu. Or, if the customer so wishes, they may exercise the right of withdrawal directly through our RETURN CENTER.


To meet the withdrawal deadline, it is sufficient that the communication concerning the exercise of this right be sent before the corresponding period expires.


In the event of withdrawal, all payments received will be refunded. However, the customer must bear the direct costs of returning the goods.


The refund will be made without undue delay and, in any case, no later than 14 calendar days from the date on which the customer informs of their withdrawal. The refund will be made using the same means of payment as used for the initial transaction, unless expressly indicated otherwise; in any case, the customer will not incur any fees as a result of the refund.

5. WARRANTIES.

All products benefit from the current legal warranty (two years from the date of delivery) covering only manufacturing defects. Damage caused by negligence, impact, or misuse is excluded.

6. CLIENT RESPONSIBILITY.

The client agrees to make a lawful use of the Website and guarantees the accuracy of provided data. The client must also facilitate delivery by providing an address where the order can be received during normal delivery hours.

10. NULLITY AND INEFFECTIVENESS OF CLAUSES.

If any clause of these Special Contract Conditions were to be declared null or ineffective, in whole or in part, such nullity or ineffectiveness shall only affect said provision or the part thereof that is null or ineffective, with the remaining General Purchase Conditions remaining in force. Consequently, the clause declared totally or partially null or ineffective shall be deemed non-existent.

12. APPLICABLE LEGISLATION AND JURISDICTION.

Purchases and sales made by the Company are subject to Spanish legislation.

In the event of any conflict or discrepancy in the interpretation or application of these contractual conditions, SA2L PHARMACIE, S.L. - NOIRFONCE submits to the consumer arbitration system / the competent courts to handle the dispute, in accordance with the applicable regulations regarding competent jurisdiction: for end consumers, at the place of fulfillment of the obligation or at the buyer's domicile.

In the event that the purchasing party is acting on behalf of a legal entity, both parties submit, expressly waiving any other jurisdiction, to the courts of the buyer's location.
